A 15 year old boy was accused by a neighbor girl and close friend of the family of sexually abuse. The boy was interrogated by police and adamantly denied the allegations. Mr. Baertschi arranged for a private polygraph examination. This process has frequently led to prosecutors deciding NOT to charge a case. The boy passed the polygraph. But in this case, the prosecutor refused to dismiss the case, which proceeded to trial. Mr. Baertschi challenged the competency of the girl as a witness. The girl was questioned by the judge and was found incompetent to testify. The legal issue of whether the prosecutor could use the girl's videotaped statement was vigorously contested. The judge ended up ruling that the statement could be used, but, after hearing the arguments including the boy's testimony, ruled in the boy's favor and found him not guilty.
A mother was charged with trespass for ignoring a school principal's order that she stay away from the school, where she was meeting with children for voluntary Bible studies in the cafeteria before school started. A national advocacy group retained the services of Mr. Baertschi to represent the woman to seek the right to continue meeting with the students. In a pretrial hearing, the State and defense filed legal memoranda concerning the rights of the school vs. the rights of parents. The Judge agreed with Mr. Baertschi's analysis and dismissed the charges against the woman, vindicating her rights as a parent to interact with students before class time.
A man was stopped and arrested for drunk driving on an ATV in a rural county. Through a contested hearing, Mr. Baertschi was able to establish that the man was denied the right to consult with an attorney before submitting to a breath test. The test results were suppressed for a violation of that right.

There are numerous other cases where strong advocacy of the defendant's position resulted in receiving very favorable negotiations such as a reduction of charges, a continuation of charges for dismissal or keeping clients from going to jail where they faced a significant jail consequence for their violation. Mr. Baertschi has an excellent relationship with the prosecutors and judges, which is a help in advancing the client's cause, even when the case against the client is very strong.
Mr. Baertschi is well prepared and conscientious in his handling of cases. He communicates with his clients on a continuing basis and gives his clients the best advice and counsel so the client can make an informed decision whether to take a case to trial or make a settlement.
